Sylar may be dead, But even the present is not written in stone. Remember FHiro was trying to change things to the bomb would not go off. So all this could change if Hiro time traveled and told someon something or somehow the battle with Nikki/Peter/Sylar/Hiro never happened so everything would be different.

Sylar isn't dead. He crawled into the sewer at the end of the season finale.
If he was dead, what would be the point of having him crawl into the sewer? Just to die?

also sylar can still kill candice during season 2 just because he didnt get her in season 1 dont mean he wont in season 2 if nathan is in season 2 im guessing it wont be the real nathan |

No, Sylar isn't dead yet. He dragged/telekinetically lifted himself into the sewer, then eventually to an ER to get himself some medical attention.
